Withdrawal of Legal Aid from family cases - whether to represent yourself?

Can I represent myself at court? Implications of the withdrawal of Legal Aid

Today is the first day for the withdrawal of Public Funding (Legal Aid) for a whole raft of cases, including Family Law.

Couples who divorce will now not have access to legal advice for questions of property division and children arrangements, unless there has been domestic violence in the relationship. Parents of children who are separated will no longer have access to legal advice if one parent refuses to allow the other to see the child. Again if there is evidence of domestic violence, public funding is still available.

So, what does the future hold for those people? How will lack of access to legal advice affect them?

Lord Neuberger, President of the Supreme Court, has this morning issued a strong warning about the impossible situation that many people will be in once Legal Aid is withdrawn for family law, employment law, welfare rights and housing.

About time! But sadly too late.

Legal Aid lawyers fought these proposals tooth and nail when they were going through Parliament, but there was very little by way of endorsement from many sections of the judiciary, or none that made the news at any rate. You may recall that there was a lot of noise about the rape issue with Ken Clarke making some ill –advised comments about the seriousness of some allegations, which distracted attention from the devastation of the proposed cuts. Coincidence? Hmm ...

What's wrong with an Internet Divorce?

Money is tight, the marriage is over, everything is amicable and you have both agreed that you should get a divorce. Why not go for a cheap internet divorce?
After all, you just need to end the marriage and get on with your lives; why bother with solicitors and legal expense? The more you save on legal cost, the more there is for each of you and for the children. Winners all round. Right?

Following on the news in May 2013 that second marriages tend to last longer than first marriages - see Good news for second marriages -  is the news that women tend to cope better with divorce than men.

While the emotional impact of the breakdown is profound for both, it seems that women tend to be able to adapt better  to major changes in circumstances - divorce, bereavement and unemployment
